Unique Industries, Inc. (“Unique,” “we,” or “us”) is strongly committed to protecting and respecting your privacy rights.  This privacy policy (the “Privacy Policy” or “Policy”) sets out the basis on which Unique collects and uses information and data from visitors to our website located at favors.com (the “Site”).  Use of the Site constitutes your consent to the terms and conditions of this Privacy Policy.

This Privacy Policy is intended to notify you of the following:

1. What information/data we collect from you through your use of the website, how that information/data may be used, and with whom it may be shared.

4. How you can correct any inaccuracies in the information provided.

What Personally Identifiable Information Will Unique Collect?

If you fill out our Request for Account form, we typically ask for your company’s name, address, structure, business characteristics, and business tax identification number, as well as individual contact information such as contact name, title, phone number, email address, and other possibly personally identifiable information.  Such personally identifiable information may also be collected by us through your voluntary submission of information as part of requesting a print catalog (for example, via “Request a Catalog”), subscribing to our email list (for example, via “Subscribe to Our E-Mail List”), and otherwise submitting messages via the Site specifically to our Customer Service or Overstock teams.

Unique does not share your email address or any other personally identifiable information with any third parties, except certain third party service providers where solely for our own business purposes, such as customer account evaluation, order fulfillment, or to provide services to us.  These service providers may have access to personally identifiable information only as needed to perform their functions.

What Tracking Information Does Unique Industries Collect?

When you visit the Site, we may send one or more “cookies” — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and helps enhance your navigation through the Site.  A cookie may also convey information to us about how you use the Site (e.g., the pages you view, the links you click, and other actions you take on the Site), and allow us or our business partners to track your usage of the Site over time and to understand trends.  A persistent cookie remains on your hard drive after you close your browser, and may be used by your browser on subsequent visits to the Site.  Persistent cookies can be removed by following your web browser’s directions.  You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent.  However, some features of the Site may not function properly if the ability to accept cookies is disabled.

We also use standard internet analytics tools, such as third-party web “tags,” to collect non-personally identifiable information about visitors to the Site, and to help analyze where visitors go and what they do while visiting our Site.

Unique uses collected information for the following general purposes:  contact with potential customers; understanding and evaluating trends; general research; and Site improvements.

How Unique Stores Its Data

Unique uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run our site.  The technical processing and transmission of data, including that which has been provided by you, may involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

We take reasonable steps to protect your information and data as you transmit it from your computer to the Site, and to protect such information and data from loss, misuse, unauthorized access, disclosure, alteration or destruction.  You should keep in mind, however, that no internet transmission is 100% secure or error-free, and you should therefore take special care in deciding what information you send to us via the Site, e-mail, or other electronic means.

Information Sharing and Disclosure

When you complete a form, we collect information including your email address.  Use of your email address will be limited to the purpose requested by you when submitting the information to us.  Notwithstanding the foregoing, where appropriate, we may occasionally use this email address to contact you for related commercial purposes.  If you do not want us to contact you for commercial purposes, you can unsubscribe from our communications as set forth in this Privacy Policy.

Notwithstanding anything else in this Privacy Policy, we may disclose personally identifiable information and other collected information when required by law, when we deem necessary to protect the rights or safety of site users, our employees or property, or when violations of our terms or conditions of use have occurred.  This includes exchanging information with third parties and organizations in connection with credit risk reduction, and the investigation or prevention of suspected fraud or illegal activity.  We may also transfer or disclose personally identifiable information if we are acquired by or merged with another company.

Links to Third Party Sites

The Site may, from time to time, contain links to external websites.  Unique encourages you to review the privacy and security policies of any externally linked websites that may be accessed through our Site.  Unique assumes no responsibility or liability for the information, collection or disclosure practices of any external websites that you access through the Site.  Please check the privacy policies of these external websites before you submit any personally identifiable information or other information to them.

Changes to this Privacy Policy

Unique reserves the right to amend this Privacy Policy at any time and from time to time.  You should check this Privacy Policy each time you use the Site to determine if any changes have been made.  If you use the Site after the amended Privacy Policy has been posted, you will be deemed to have agreed to the amended Privacy Policy.

About Children

Unique does not knowingly collect information from children under the age of 13 through the Site.  If you are under the age of 13, please do not provide any information through the Site.  We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children to never provide any information on this Site or any other web site without their permission.  If you have reason to believe that a child under the age of 13 has provided information to Unique through the Site, please contact us by phone at 215-336-4300 or 800-888-0559, or by email at webmaster@favors.com, and we will endeavor to delete that information from our databases.

How Do I Change My Information or Opt-Out?

If you wish to change the information submitted to Unique through the Site, or no longer wish to receive communications from Unique, please send an email to webmaster@favors.com.  Be sure to include your email, name, company name, and clear statement of your request so we can confirm that the requested changes are made or confirm that you are removed from our system.

California Privacy Rights [Effective January 1, 2023]

This Section, titled “California Privacy Rights,” supplements the rest of the Policy but is applicable only to California consumers.  This Section uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018, as amended (including by the California Privacy Rights Act of 2020) and its implementing regulations (collectively, the “CCPA”) or otherwise under California law.

Categories of Personal Information.

Unique may collect or receive (and may have collected or received during the twelve (12) month period preceding the date of the Privacy Policy) the categories of personal information below.  Please note, not all categories may be collected (or received) for every California consumer.

• • Identifiers such as name, postal address, email address, telephone number, account name, social security number, and signature;
  • Financial Information such as credit or debit card numbers, bank (or other financial) account numbers, and claims information;
  • Commercial Information, such as products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;
  • Internet or other electronic network activity information including, but not limited to, information regarding a consumer’s interaction with the Site; and
  • Communications such as the content of emails, text messages, or other communications, call logs, and calendar information where Unique is a party to the exchange.

Categories of Sources.

Unique may obtain and combine personal information from various sources.  This includes the sources described in the Privacy Policy (see, in particular, the Sections titled “What Personally Identifiable Information Will Unique Collect?” and “What Tracking Information Does Unique Industries Collect?”) as well as from the following:

• • Active collection (e.g., direct input from an individual);
  • Passive collection (e.g., website cookies; see the Section titled “What Tracking Information Does Unique Industries Collect?”); and
  • Third parties, such as our affiliates, business partners, and service providers.

Purposes of Collecting Personal Information

Unique may use your personal information for the purposes described in the Privacy Policy (see, in particular, the Sections titled “What Personally Identifiable Information Will Unique Collect?” and “What Tracking Information Does Unique Industries Collect?”) and as provided below:

• • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments;
  • Undertaking activities to verify or maintain the quality or safety of our services or goods and to improve, upgrade, or enhance them;
  • Debugging to identify and repair errors;
  • To conduct business analysis, such as analytics, projections, identifying areas for operational improvement;
  • To conduct research and development, including undertaking internal research for technological development and demonstration; and
  • To fulfill our legal functions or obligations.

UNIQUE DOES NOT SELL OR SHARE PERSONAL INFORMATION, INCLUDING PERSONAL INFORMATION OF CALIFORNIA CONSUMERS.

How Long We Retain Personal Information

Unique retains personal information for as long as needed or permitted considering any purpose(s) for which it may have been collected.  Unique uses the following criteria to determine retentions periods:

• • The length of any ongoing relationship between you and Unique;
  • The length of time Unique may provide services to you;
  • Business needs to reference personal information to address potential issues;
  • Any applicable legal obligations; and/or
  • Unique’s internal retention policy.

Your California Privacy Rights

The CCPA provides you with the following rights, which Unique will attempt to fulfill to the extent required by the CCPA:

• • Right to Know. You have the right to request that Unique disclose to you what personal information we have collected about you.  You may make such a request up to two (2) times in a rolling twelve (12) month period.  If you make a request to know what personal information Unique has collected about you, Unique will provide you with the following information:
    • Categories of personal information collected about you;
    • Specific pieces of personal information Unique has collected about you;
    • Categories of sources from which Unique collected your personal information;
    • Business purposes for which we use your personal information;
    • Categories of third parties to whom we have disclosed your personal information; and
    • Categories of information that the business discloses to third parties.
  • Right to Delete. You have the right to request that Unique delete personal information that we have collected from you.  Please note that if you request deletion of your personal information, we may deny your request (or otherwise retain certain elements of your personal information) subject to certain applicable exceptions under the CCPA.
  • Right to Opt-Out. California consumers generally have the right to opt-out of the sale or sharing of their personal information, along with the right to opt-in to the sale of such information.  NOTE:  UNIQUE DOES NOT SELL OR SHARE PERSONAL INFORMATION, INCLUDING PERSONAL INFORMATION OF CALIFORNIA CONSUMERS.
    • Pursuant to the CCPA, “share” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, of consumer’s personal information by Unique to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and of third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.
  • Right to Correct. You have the right to request that Unique correct inaccurate information that we have about you.
  • Right to Limit. California consumers generally have the right to direct businesses to only use your sensitive personal information for limited purposes. UNIQUE DOES NOT USE OR DISCLOSE SENSITIVE PERSONAL INFORMATION FOR ANY PURPOSES THAT WOULD REQUIRE A CONSUMER TO EXERCISE A RIGHT TO LIMIT ACCORDING TO CALIFORNIA LAW.
  • Right to Non-Discrimination. Unique will not deny you goods or services, charge you a different price, or provide a different level or quality of goods or services just because you exercised your rights under the CCPA.  Please note, however, if you refuse to provide your personal information to Unique or ask Unique to delete your personal information, and that personal information or sale is necessary for Unique to provide you with goods or services, Unique may not be able to complete that transaction.

Identity Verification

After a request is submitted, Unique must verify your identity in order for us to properly respond and/or confirm that it is not a fraudulent request.  To verify your identity, we will request, at a minimum, that you provide your name, email address, phone number, address, and relationship to us, so that we can seek to match this information with the information existing in our systems.  When providing Unique this information, you represent and affirm that all information provided is true and accurate.  If we are unable to verify that the consumer submitting the request is the same individual about whom we may have collected personal information, we may contact you for more information, or we may not be able to meet your request.

Authorized Agent

If you would like an authorized agent to exercise any California privacy right(s) on your behalf, they may use the same processes above to submit such requests.  However, please note that Unique may verify any such request by requiring valid documentation demonstrating your agent’s authority to submit such requests on your behalf (or requiring that you verify your identity directly).  Valid documentation shall include: (i) a valid power of attorney; or (ii) a letter, signed by you authorizing the agent to submit requests on your behalf.  Documentation may be sent via email to ConsumerPrivacy@favors.com or mailed to Unique via regular mail to 4750 League Island Boulevard, Philadelphia, PA 19122-1222, Attn: Legal Department up to ten (10) business days after a request is made.
